Can local restaurants legally ban customers who don’t tip?

A TikTok user claims she was banned from one of her favorite restaurants because someone she was with was a serial non-butcher. Are you obligated to tip your server and is this restaurant breaking any laws?

You can tell you don’t have to tip, but they probably should.

Should a restaurant ban people who consistently refuse to tip?

The issue sparked quite a debate online after the TikTok user named Büeli admitted that she was denied service for being associated in a restaurant with one or more of her friends who constantly frequent there and do not don’t tip.

The video has garnered a lot of attention as it currently has over a million views.

Ironically, she’s a tattoo artist who encourages her clients to tip, but she doesn’t feel like everyone who works in a profession that deserves a tip does.

Can a restaurant legally do this? Is this a form of discrimination?

According to local attorney, Alex Mainetti of Mainetti & Mainetti, the restaurant can get away with this ban since it bans people who practice a certain behavior. They are not banned because of anything like race, gender, or religion. It might not be good business, but it might not be illegal either.

Do you work for tips? How insulting is it when there’s no tip? If a customer can’t afford to tip, do you mind or do you expect something every time?
